University-Maine-Student-Ryan-Ouimet.JPGRyan Ouimet, 23, is accused of shooting and killing his college friend, Andrew Holland in the apartment of a mutual friend last month.

The Colts Neck High School graduate charged in the shooting death of his close friend in Maine last week was dancing and tossing the gun between his hands when it fired, and had smoked marijuana that night, according to court papers filed today.

Ryan Ouimet, 24, appeared in Franklin Superior Court in Farmington, Maine, today. He faces a manslaughter charge in the May 31 shooting that killed Andrew Holland.

A plea was not requested from Superior Court Judge Michaela Murphy. Michael Cunniff, Ouimet’s attorney, said his client will ultimately plead not guilty to the charges, calling the shooting a “tragic accident.”

“The Maine State Police and the prosecution have been conducting a very responsible and diligent investigation,” Cunniff said today. “I anticipate the outcome of our investigation will confirm our belief this was an unfortunate tragedy and that it was an accident.”
